Accepting Kidney donations from Mentally Challenged –Issues

    Mr Radheyshyam the unfortunate father who’s elder son Mr Kaushal is suffering from kidney failure due to wrong medication and the younger son Ganshyam is a diagnosed with sever mental retardation since child hood, has limited choice.

    Mr Radhey shyam’s petition in the courts that the kidney from his younger son should be transplanted to his elder son, raises several questions.A family that has so far been taking decisions on every thing for the mentally challenged son, also have the right to decide whether or not he can donate an organ? It's also case which challenges existing notions of medical propriety.

    The petitioner claims that if no one in the family objects, what is the problem of acceptance of the donation. In his pleas he says that the kaushal the kidney failure patient, is the only earning member in the family and has two children and a wife to support apart from his younger brother and his fatherHe pleads the court to rescue his family from disaster.

    The courts has to decide and there is likely to be an intense debate. on the issue of organ donations from a mentally challenged .
